Sometimes after a surgery or is someone is injured off the job they fall under Temporary Disability. Therefore, the American Disabilities Act provides some protection. In addition, family Medical Leave Act can protect these individuals as well. Some people may not be able to work, so if these individuals have worked for a year they can fill out FMLA leave, and their jobs are secure for up to 12 weeks. If people are getting fired over surgeries or a temporary disability at your jobs that sucks. It is not right.
Now I have read that if light duty would be to much of a hard ship to the employer for some of these cases then the job does not have to supply light duty. This is not true every time. However, as I said FMLA and short term disability should still protect these individual’s jobs.
