OK…It is legal for a nurse to CALL IN an order to the pharmacy, but to physically write a prescription to be filled in a retail pharmacy is not legal, the nurse is essentially SIGNING that they are the provider. Retail and Hospital pharmacy laws are VERY different as far as dispensing medication and how orders are taken. All the pharmacist has to do is call the doctor to verify the prescription.
The dispensing laws in a hospital are different then that of a retail pharmacy (the outpatient pharmacy in a hospital is considered a retail pharmacy). If the family took that prescription to ANY OTHER PHARMACY like it says in the original post. The family member might have had the police called…
I worked as a Tech for 10 years before I became a nurse. I have called the police before on forged prescriptions or if a prescription looked like it was signed by someone else.
